ℹ️ Right to Information Act, 2005 (RTI)

🏛️ The Right to Information Act 2005 (RTI) is an Act passed by the Indian Parliament to ensure transparency and accountability in the administrative system. This law empowers every Indian citizen with the complete right to access information held by government institutions.

🎯 Main Objectives

• 👁️ Ensuring Transparency: Making the functioning of government systems fully transparent to the general public.

• 🛑 Eradicating Corruption: Preventing corruption by keeping citizens informed about administrative matters.

• 🤝 Public Participation: Empowering citizens to actively participate in the democratic process.

• 📋 Accountability: Making government officials more accountable and answerable to the public.

📝 Application and Time Limits

• 👤 To Whom to Apply?: Applications can be submitted to the Public Information Officer (PIO) of the respective office.

• 💰 Fee Structure: The standard application fee is ₹10. Applicants Below the Poverty Line (BPL) are completely exempted from paying the fee.

⏱️ Time Limits for Receiving a Reply:

⚖️ Appeal System

If the requested information is not provided within the time limit, or if the information provided is incorrect/incomplete, an appeal can be filed as follows:

1. First Appeal:

   • Must be submitted to the Senior/Higher Officer of the same office within 30 days from the expiry of the response window or from the date the reply was received.

2. Second Appeal:

   • If the First Appeal does not resolve the matter, a second appeal can be filed with the State/Central Information Commission within 90 days.

🚫 Exempted Information (Section 8)

In the interest of national security, the government is not bound to disclose the following information:

• 🛡️ Matters affecting the security, sovereignty, and strategic interests of the nation.

• ⚖️ Information expressly forbidden to be published by any court of law.

• 🌐 Information received in confidence from foreign governments.

• ⚠️ Matters that would endanger the life or physical safety of any individual.

🛑 Penalties: If an official fails to provide information or rejects an application without a valid reason, the Commission has the provision to impose a fine of ₹250 per day, up to a maximum of ₹25,000, on the responsible officer.
